Description: The process of adding on a
second story to a single-family home, remodeling an existing
two-story home, or building a new two-story residence on a vacant
parcel, necessitates becoming aware of the related guidelines and
requirements and obtaining the required building permits. Depending on the
situation, a Second-Story Review approval
may be required from the City’s Planning Division before the Building Safety Division can issue a building permit for the
project.
Examples: Instead of purchasing a new home, many families
choose to add on a second story to meet their growing needs.
Additions can be as small as a room above the garage or an entire
second story with several rooms. New construction with a
second-story that abuts existing residential areas (10 years and
older) also requires Second-Story Review approval.

Contact the Planning Division to determine
if a second story addition can be added to the
existing home, or if a new two-story home must be built,
and what process will need to be followed to get
approval of a second-story addition review.

- Assessor's Parcel Number (APN)
- Visual schematic of the proposed project
If the proposed project meets the zoning
requirements, the
process noted in 'Submit an Application' will
typically follow. If not, staff will advise you of
additional approval criteria.
Submit an Application
Application and building plans are reviewed to
assure that construction meets minimum life-safety requirements. Depending upon the type of
project, and the complexity of construction,
staff will examine the plans for conformance to
these requirements. Once the application packet
has been determined to be complete, most projects will
take 45-60 days to process. Some projects may take
longer than others depending on environmental impacts
and other considerations.

- 1 Uniform Application
- 1 Second-Story Review Application
- 2 copies of your site plan (see
plot plan requirements)
- 2 copies of proposed and existing
first- and second-floor plans
- 2 copies of proposed structure in
elevation showing north, south, east and west views
- Payment for Second-story Review Fee

Project Review
A Project Planner
will be assigned to process the application and
will review the application with staff members
for their input.
adjacent Property Owner Notification
After
the application is submitted and reviewed, a letter
of notification to the applicant and adjacent
neighbors will be mailed indicating a 15-day
deadline by which the application will be considered for
approval. Any input regarding the second-story
dwelling review should be made at that time.
administrative approval
Once the project is approved by the Planning
Division, there is then a 15-day appeal
period,
as required by Article 27 of the Modesto
Municipal Code. If no appeal of the tentative
approval
has been received by 5:00 p.m. on the determined
designated date, the approval decision stands and
the applicant is authorized to
seek a building permit from the Building and
Development Services Division.

Within 15-days following the date of the decision,
the applicant or adjacent property owners may appeal the
Planning Division’s decision to the Board of Zoning
Adjustment by filing a letter of appeal with the
appropriate fee, with staff at the Planning Division
counter.
Submit Building Plans
Once the second-story plot plans are approved, building plans
will need to be submitted. Building plans are reviewed
to assure that construction meets minimum life-safety
requirements. Depending upon the type of project, and
the complexity of construction, staff will examine the
plans for conformance to these requirements.
