City of Modesto District 5 Ad Hoc Committee
On August 10, 2010, the City Council appointed a Council subcommittee to
solicit applications from eligible candidates from City Council District 5 to
serve as an Interim Councilmember until the election of November 8, 2011. The
vacancy is due to the impending resignation of Councilmember Olsen on November
4, 2010, upon her election to the California Assembly. (The November 8, 2011
District 5 Councilmember will be for a term of two years; the next regularly
scheduled City Council District 5 Election will be held November 5, 2013.)
The Ad Hoc Committee will schedule and conduct interviews of all candidates
in meetings which are governed by the Brown Act and are open to the public.
Once the interview process has been completed, the Committee will recommend the
top candidate(s) to the City Council for consideration and appointment at the
Council’s November 9, 2010 meeting. At the August 16, 2010 Ad Hoc Committee
Meeting, the following timelines were scheduled:

Requirements
CHARTER SECTION 501(b). - METHOD OF ELECTION.
(b) District Councilmembers. The Six (6) Councilmembers shall be elected by
district as described in this section. A candidate for, and councilmember of,
each district must live in that district to be eligible to run for or hold the
office of councilmember for that district. Only voters who live in a district
shall be eligible to vote in the election for councilmember of that district.
CHARTER SECTION 701. - ELIGIBILITY.
No person shall be eligible to be nominated for or to hold office as a member
of the Council or as Mayor unless the person is and shall have been for at least
thirty (30) days preceding the person's nomination or appointment a resident and
registered elector of the City of Modesto or of territory annexed thereto.
